Terms and Conditions
The following terms and conditions apply to the booking of educational offers at the Edwin Scharff Museums.
Please note: German shall be the legal language of these terms and conditions, and all parties waive any right to use and/or rely upon any other language, translation or interpretation. In the case of any inconsistencies or interpretation disputes, the German language version shall control.
1. Signature of contract / booking information
The contract is binding between the Edwin Scharff Museum (also referred to as ‘we’ or ‘us’) and the customer (also referred to as ‘you’).
The contract shall come into force for both parties on receipt of the email confirmation. The contract may only be cancelled as set out in our cancellation policy.
2. Prices and payment
Prices for our services are exempt from VAT, according to § 4 No. 20 a UStG (German Value Added Tax Act). You may pay for your booking in advance by bank transfer, or on the day of your visit. For security reasons the Edwin Scharff Museum does not accept € 200 and € 500 banknotes. Exceptions might be made, if agreed in advance, for payment on receipt of invoice.
3. Shipping
We shall email the booking confirmation and invoices at the customer’s risk to the email address provided. The risk of loss shall pass to the customer once the email has been transferred to the provider.
4. Bookings
All guided group tours are limited to a certain number of participants per group. The Edwin Scharff Museum shall organise one or several guides for the group tours on receipt of the booking confirmation. The Edwin Scharff Museum reserves the right to select the guides. The bookings are subject to booking deadlines and visitor guidelines.
5. Cancellation policy
Guided group tours may be cancelled by email: esm-buchungen@post.neu-ulm.de. Cancellations with 14 days’ notice are free of charge. Payments already made for the booking shall be reimbursed in full. Cancellations with less than 14 days’ notice, shall be charged a € 25.00 fee. Group tours cancelled less than 24 hours in advance, or no shows shall be charged in full. The customer shall have to provide proof of the cancellation emailed within the cancellation deadline. The Edwin Scharff Museum shall not be liable for cancellations of educational offers due to force majeure. You shall not be eligible to reduce the price, unless your guided tour, as specified in the booking confirmation, is delayed by more than 30 minutes.
6. Compensation for damages
The Edwin Scharff Museums reserves the right to close certain parts of the museum for structural or organisational reasons. In any such event you shall not be eligible to claim damages.
The Edwin Scharff Museum shall only be liable in case of intent and gross negligence. For the avoidance of doubt, nothing in these terms and conditions shall limit our liability to you for injury of life, body or health nor for the breach of substantial contractual obligations (any condition that is essential for the fulfilment of the contract); or any other liability that cannot, as a matter of law, be excluded or limited. The museum shall not be liable for immaterial damages or loss of income. Compensation is limited to the typically expected damages, usually not exceeding the amount you paid for the museum’s educational offer.
7. Collection of data
For the performance of the contract we shall store and process your name, address, email address and phone number for the duration of the contract. Only Edwin Scharff Museum staff involved in the performance of the contract shall have access to this data. You shall inform the Edwin Scharff Museum about changes regarding this data without delay.
Name, address, phone number and email address shall only be saved with your explicit consent in the museum’s database used for visitors’ services.
The data shall be stored within the statutory retention periods.
8. Miscellaneous
The Edwin Scharff Museum reserves the right to change any of these terms at all times without notice. This shall not affect bookings already made. If any of these terms become void or ineffective, the validity of the contract shall not be affected. Any contract shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sales of Goods (CISG). Place of performance for all obligations and payments is Neu-Ulm. The legal venue for all disputes is Neu-Ulm.
